These Terms and Conditions constitute a legally binding agreement (“Agreement”) between You (“the Client”) and Mongolia Trekking LLC (“the Company”). By submitting a booking and/or making payment, the Client agrees to be bound by all provisions set forth herein.
1.1 Provision of Services.
The Company shall provide travel services in accordance with the agreed itinerary and the service standards specified at the time of booking. The Company is responsible only for services it directly arranges and invoices.
1.2 Limitations of Liability.
The Company shall not be liable for any loss, damage, delay, or failure in performance arising from:
(a) force majeure events, including but not limited to extreme weather, natural disasters, fire, flooding, public transport or airline disruptions, strikes, civil unrest, quarantine, government restrictions, war, acts of terrorism, or other political or regulatory actions;
(b) the Client’s own health conditions or failure to comply with health, visa, or documentation requirements.
1.3 Excluded Services.
The Company bears no responsibility for services not contracted with or paid to the Company, including but not limited to international flights, transit accommodation, and travel insurance.
1.4 Inherent Risks.
Active and adventure travel inherently involves certain risks. The Company shall notify the Client of such risks when reasonably possible and shall take all reasonable measures to mitigate them. The Company will provide visa support documentation and guidelines for Mongolian visa procedures.
2.1 Deposit.
A non-refundable deposit of USD 400 is required to secure a place on the selected tour.
2.2 Confirmation.
Upon receipt of the deposit, the Company will issue a written booking confirmation and provide a detailed packing list for the chosen tour type.
2.3 Balance Payment.
The remaining balance must be paid no later than 60 days prior to the tour start date.
Bookings made within 60 days of departure require full payment at the time of booking.
3.1 Client-Initiated Cancellation.
Cancellations must be submitted in writing by the Client or an authorised representative. The following charges apply based on the date written notice is received:
3.2 Company-Initiated Cancellation or Amendment.
The Company reserves the right to cancel or amend the Client’s travel arrangements due to force majeure or governmental travel restrictions, warnings, or advisories. Written notice will be provided. The cancellation penalties above shall apply from the date the Client is notified.
3.3 Price Adjustments Due to Amendments.
If amendments increase the cost of the Client’s holiday, the Company will invoice the difference subject to the Client’s acceptance. If costs decrease, the Company will refund the difference.
3.4 No Refund for Unused Services.
Once the tour has commenced, no refunds will be issued for unused services, including but not limited to accommodation, meals, sightseeing, activities, internal flights, transport, or guiding services, where such non-use is outside the direct control of the Company.
3.5 Exclusion by Tour Leader.
No refund shall be issued if the Client is excluded from the tour by the Tour Leader/Guide for reasons outlined in Clause 4.3 of this Agreement.
4.1 Fitness and Suitability.
The Client must be in an appropriate physical condition to participate in the tour and must understand the risks associated with active travel.
4.2 Client Obligations.
The Client is responsible for:
(a) obtaining and carrying all valid travel documents, visas, and health certifications;
(b) disclosing medical conditions and dietary requirements at the time of booking;
(c) covering costs of personal equipment, airport taxes, gratuities, visas, vaccinations, additional food or beverages, and optional activities not included in the itinerary.
5.1 Any service-related complaint must be raised immediately with the Tour Leader/Guide so that prompt corrective action can be taken.
5.2 If the issue is not resolved on-site, the Client must notify the Company’s management as soon as reasonably possible.
5.3 If on-tour reporting is not possible, the Client must submit a written complaint within 30 days following the tour’s conclusion. Complaints submitted after this period may not be actionable.
It is a condition of booking that the Client obtains adequate travel insurance covering:
Proof of insurance must be available upon request.
Tour prices are based on twin-share accommodation.
A single supplement fee applies if the Client requests single occupancy or if a same-sex roommate cannot be provided. The fee will be quoted separately.
